1. Introduction
Welcome to Tech Orbisys IT Solutions ("Company," "we," "our," "us"). These Terms and Policies govern the use of our services,
including website development, hosting solutions, and associated services. By accessing or using our services, you agree to comply
with and be bound by the terms outlined herein. If you do not agree, you may not engage our services.
2. Company Registration
Tech Orbisys IT Solutions is officially registered under the Companies Commission of Malaysia (Suruhanjaya Syarikat Malaysia, SSM).

We ensure that all our operations adhere to Malaysian laws and regulations to uphold transparency, credibility, and security for our clients.
3. Scope of Services
Our primary services include:
3.1 Website Development
- Custom website designs tailored to your requirements, including corporate websites, e-commerce platforms, and personal portfolios.
- Integration of modern technologies such as responsive design, SEO optimization, and user-friendly interfaces.
3.2 Hosting Solutions
- Scalable hosting packages, including domain registration, server management, and advanced security features.
- Options for shared, VPS, and dedicated hosting based on client needs.
Additional services may include maintenance packages, digital marketing integrations, and consultation on IT solutions.
4. Hosting Services
4.1 Subscription Plans
- Hosting plans are billed on an annual or agreed subscription basis.
- Non-renewal of services by the due date will lead to automatic suspension. Service restoration post-suspension may incur additional charges.
4.2 Data Responsibility
- Clients are responsible for maintaining personal backups of their data. While we may provide backup services as an add-on, we are not liable for data loss caused by external factors, technical failures, or client negligence.
4.3 Prohibited Content
Hosting services must not be used to store or distribute content that includes, but is not limited to:
- Illegal or unauthorized copyrighted materials.
- Malware, including viruses or ransomware.
- Content that infringes Malaysian laws, promotes hate speech, or incites violence.
4.4 Downtime and Maintenance
- We guarantee 99.9% uptime for hosting services, excluding scheduled maintenance or unforeseen events.
- Clients will be notified at least 48 hours prior to scheduled maintenance.
- We are not responsible for interruptions due to third-party failures, cyber-attacks, or force majeure events.
5. Website Development
5.1 Development Timeline
- Timelines for project delivery will be clearly outlined in the agreement.
- Delays caused by incomplete client-provided materials, unclear instructions, or lack of approval may extend the deadline without penalties to the Company.
5.2 Ownership of Code
- Full ownership of the website code and assets is transferred upon final payment unless otherwise specified.
- Open-source components or third-party libraries used in the project will remain under their original licenses.
5.3 Warranty Period
- A warranty period of 30 days post-project delivery will cover bug fixes or performance issues directly related to development.
- Requests for enhancements, changes, or new features beyond the warranty period will be treated as a new service order and may incur additional costs.
6. Payment and Invoicing
6.1 Payment Terms
- All payments must be made in Malaysian Ringgit (MYR) unless mutually agreed otherwise.
- Website development projects require a 50% deposit to initiate work, with the balance payable upon completion.
6.2 Hosting Services
- Hosting services require upfront payment for the chosen subscription period (e.g., annual).
6.3 Invoicing
- Detailed invoices will be provided for all transactions, including our SSM registration number to comply with Malaysian law.
7. Refund and Cancellation
7.1 Hosting Services
- Hosting service payments are non-refundable once activated unless we fail to deliver the agreed services due to negligence.
7.2 Website Development
- Refunds for website projects will be considered only if the cancellation occurs before substantial progress is made.
- Deposits for projects with significant work already completed are non-refundable.
8. Privacy Policy
We are committed to protecting client information in line with the Personal Data Protection Act 2010 (PDPA) of Malaysia.
- 8.1 Data Collection and Use: Data is collected solely for service delivery, invoicing, and support purposes.
- 8.2 Data Security: We implement industry-standard security measures to safeguard client data. However, clients should also take precautions to protect their information.
